These Terms of Service ("Terms") are entered into between Fastflowzy Logistics Ltd (VAT: GB538201946, Registration: 12938475), a company registered in England ("we," "us," "our," or "Company"), and you, the user or customer ("you" or "Customer"). These Terms govern your use of our website, mobile application, and courier/delivery services (collectively, the "Services").

By accessing our website, using our application, or engaging our delivery services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use our Services.

2. Services Description

Fastflowzy Logistics Ltd provides fast, reliable same-day delivery and courier services across the United Kingdom. Our services include but are not limited to:

  • Same-day courier delivery
  • Next-day delivery
  • Scheduled delivery appointments
  • Parcel collection services
  • Temperature-controlled logistics
  • Document delivery services

All services are subject to availability, location eligibility, and acceptance of your booking request. We reserve the right to decline any service request at our sole discretion.

3. User Accounts and Registration

To use certain features of our Services, you may be required to create an account. You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

You must notify us immediately of any unauthorised use of your account or any other breaches of security. We are not liable for any losses resulting from unauthorised use of your account if such use occurs due to your failure to protect your credentials.

4. Booking and Acceptance of Deliveries

When you request a delivery service through our website or application, you submit an offer to contract with us. Your booking becomes a binding contract only when we confirm acceptance via email, SMS, or our application.

You must ensure that:

  • The delivery address is accurate and accessible
  • All package details are correctly provided
  • Hazardous materials are properly declared
  • Goods are properly packaged and secured
  • You have authority to arrange delivery

We may cancel any booking if the delivery address is inaccessible, incomplete, or invalid. Cancellation charges may apply according to our cancellation policy.

5. Payment Terms

Payment must be made in full before or at the time of service delivery, unless alternative payment arrangements have been agreed in writing. We accept all major credit and debit cards, bank transfers, and other payment methods displayed on our platform.

Prices are subject to change without notice. Current pricing is displayed on our website and application at the time of booking. Additional charges may apply for:

  • Out-of-area deliveries
  • After-hours collections or deliveries
  • Oversized or overweight items
  • Special handling requirements
  • Failed delivery attempts

All prices exclude VAT where applicable. You will be notified of any additional charges before confirming your booking.

6. Cancellation and Refunds

Cancellations requested more than 2 hours before scheduled collection will be refunded in full. Cancellations made less than 2 hours before scheduled time may be subject to a cancellation fee of up to 50% of the service charge.

Cancellations requested after the driver has commenced journey or after delivery has been attempted are non-refundable. Refunds will be processed within 5-10 business days to the original payment method.

We reserve the right to cancel services that violate these Terms or applicable law, and refund only the service charge (minus any applicable fees).

7. Liability and Limitations

Our total liability under these Terms shall not exceed the value of the service charge paid. This limitation applies to all claims, including negligence, breach of contract, and statutory liability.

We are not liable for:

  • Loss or damage to goods caused by inadequate packaging by the sender
  • Consequential, indirect, or special damages
  • Loss of profits, revenue, data, or business opportunity
  • Delays caused by circumstances beyond our reasonable control (force majeure)
  • Damage to property due to normal wear and tear
  • Delays caused by customer-provided incorrect information

Claims for loss or damage must be reported within 48 hours of delivery. Items must be inspected by the customer upon receipt before acceptance.

8. Goods Restrictions

We cannot deliver items that are:

  • Illegal or hazardous without proper declaration and licensing
  • Perishable without appropriate temperature control (unless our special service is used)
  • Fragile without proper protective packaging
  • Valuable items without insurance declaration
  • Subject to export/import restrictions
  • Offensive, obscene, or defamatory in nature
  • Biohazardous or infectious materials
  • Stolen property or proceeds of crime

You warrant that all goods being delivered comply with applicable law and these restrictions. We may refuse to deliver items suspected of falling into restricted categories.

9. Delivery Attempts and Non-Delivery

We will make reasonable efforts to deliver your package to the specified address. If delivery cannot be completed, we will attempt to contact you to arrange an alternative delivery time.

Reasons delivery may not be completed include:

  • Address is inaccessible or incorrect
  • Recipient is not available
  • Recipient refuses delivery
  • Package is damaged and unopened
  • Weather or traffic delays

After three failed delivery attempts, we may return the item to the sender. Return shipping fees will be charged to the original payer unless alternative arrangements are made.

10. Intellectual Property Rights

All content on our website and application, including text, graphics, logos, images, and software, is owned by or licensed to Fastflowzy Logistics Ltd and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without written permission. Unauthorised use may result in legal action.

11. Data Protection and Privacy

We collect and process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data.

Termination does not affect your liability for prior breaches or unpaid charges.

  • Your violation of applicable law

16. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the English courts.

18. Insurance

Basic liability coverage is included with all deliveries up to £20. For items of higher value, we recommend purchasing optional goods-in-transit insurance. Insurance does not cover loss due to inadequate packaging, undeclared fragility, or prohibited items.

Insurance claims must be accompanied by photographic evidence of damage and the original packaging.

19. Safety and Security

You are responsible for ensuring safe and legal delivery. We may refuse delivery to locations deemed unsafe or where access cannot be gained. Drivers may refuse delivery in dangerous weather conditions or if the recipient cannot be safely reached.

Your payment of the service charge does not guarantee delivery in extreme weather or conditions beyond reasonable control.

20. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services constitutes acceptance of modified Terms.

We recommend reviewing these Terms regularly for updates.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if impossible, severed. Remaining provisions shall continue in full force and effect.
